When multiple vehicles are involved in a crash, the results can be devastating. Aside from worrying about their injuries, victims also face issues with knowing who to pursue for their damages. Determining fault is not always easy, especially when multiple cars are involved.

The more vehicles involved in a crash, the greater the chances of significant injuries and damages. With help from John Flood, injured victims will be able to better understand their rights and how to pursue fair compensation. 

Before leaving the scene of the accident, injured victims need to make sure they file a police report and collect insurance information from all drivers. Being prepared to pursue the matter with the insurance company is vital. 

Who Is Held Liable in a Three-Way Car Accident?

Although it can sometimes be easy to determine fault in a car accident, this is not always the case. More difficult crashes, such as three-way accidents, are often difficult to determine fault. When fault is at question, the insurance adjuster will perform a thorough investigation. 

Investigations into three-way accidents involve careful consideration. Insurance adjusters must work with the police officer that drew up the police report. They must also contact any witnesses and interview each driver involved in the car accident. 

The process is typically lengthy and will sometimes end in an unfair decision. In the event of problems with determining liability, many injured victims make the decision to hire a lawyer to help them with their claim. 

Factors That Will Affect Driver Liability

There are multiple factors that are considered when it comes to driver liability. Being aware of these factors will help injured victims to be better prepared for the process. The following offers information on some of the factors that are considered when determining liability. 

  • Were any drivers intoxicated or under the influence?
  • Was anyone speeding?
  • Was distracted driving a factor?
  • Did any driver fail to use signals?
  • Did a driver fail to follow signs and traffic lights?
  • Did any driver fail to follow at a safe distance?

These are all factors that will come into play when deciding on liability. All of the factors above could result in a citation being given to a driver, which could result in proof of negligence. 

Should a Victim Hire a Lawyer?

One of the most important decisions an injured person will need to make is whether to hire a lawyer. While minor fender benders likely will not require legal intervention, three-car accidents often need assistance. 

It is advantageous for injured victims to at least meet with a lawyer for a consultation. Consultations will allow injured individuals to discover important information on their rights and what will be involved in pursuing compensation. Often, consultations are offered at no charge for new clients. 

A lawyer will become an advocate for their client. They will work with the insurance company and can even pursue a lawsuit if it becomes warranted. In the event liability is questioned, having a lawyer working on the side of the victim is helpful for guidance and peace of mind. 

Conclusion

The aftermath of a serious three-way car accident can be devastating. Often, injured victims are left in a state of confusion because they are unsure of how to get the compensation they are owed. If liability is in question, it is wise to get legal guidance from a lawyer.
