Choosing Representation is Easy: 5 Questions to Ask during Your Personal Injury Consultation

05.28.2018 by Girl on Fire // Leave a Comment

Have you suffered an injury recently and don’t know where to begin with seeking your legal rights? Or maybe you’re representing an injured member of your family. Choosing a lawyer to handle your case is the best thing to start with. But not every lawyer is best fit to handle your case. You need the right lawyer from the vast majority out there. And the best way to get one is through scheduling a consultation. And it’s through asking the right questions where you will get the right personal injury attorney. Here are five simple but effective questions to help you.

Personal Injury

  1.   What experience do you have in handling such type of cases?

Just like a neurosurgeon cannot be hired to perform a heart operation, lawyers have specialties too. Get to know what (s)he majored in. Don’t be content with the information claimed on the website of a personal injury lawyer or by the lawyer him/herself during their first introduction to you. Dig deep into his/her experience in the cases (s)he has handled to get to know the success rate with such cases. Ask also for the reputation of their law firm and the lawyer’s lifestyle. Finding the best personal injury law firm will be an advantage to you and your case.

  1.   Who will be personally overseeing my case?

Meeting a personal injury lawyer during your first consultation is not an assurance that (s)he will be the one to handle your case, either part or all of the case. How about you find out and not just assume? It is not bad that someone else is assigned to handle your case. But you should first inquire to know who the person is. And if the person is a legal assistant or a lawyer. Get to know if the person has some experience in the legal practice or not. Inquire to know if you can be able to meet and talk to the person prior to trusting the legal representative. How comfortable are you with the person?

  1.   What basis do you use to charge your services?

You are going through enough stress at the moment to start wondering if you might face steep legal fees should you lose the case. Well, this will not happen if you hire a lawyer who charges on a contingency basis. This way, you will only pay if your case is successful. Some attorneys charge on an hourly basis. Which is not a good option to go for since there is no certainty in the number of hours your case will take to be solved. So inquire to know if the lawyer charge on a contingency basis. And if yes, what percentage.

  1.   What kind of monetary compensation should be included in my claim?

This is dependent on the accident type, level of injury, and the sort of claim among other factors. There are monetary caps for a variety of injury claim types. Ask the lawyer to help guide you on which could be:

  • Compensation for loss of limbs or life.
  • Compensation for pain and suffering.
  • Payment for current and future loss of wages.
  • Payment for current and future medical bills.
  1.   How often do your cases go to trial?

A variety of personal injury cases are settled out of court. But having your case settled at the right time is what you should prioritize during your consultation with the personal injury lawyer. (S)he should not be willing to settle the case only when it is convenient for them. If fighting in the court is what will make your legal rights heard and settled, then let it be.

Conclusion

Choosing the right person to handle your case is not an easy task especially when you didn’t know the right questions to ask during your consultation. But not anymore, now you know. These questions are enough to get you your lawyer. And by finding the perfect person, you will hardly lose the case. So, choose wisely and don’t be scared to ask the questions. You’re the Boss! And bosses know what they want and go for it.
